출애굽기 21:1-22:15

 하나님께서는 백성들에게 종에 관한 법, 사형 죄에 관한 법, 그리고 사람이나 재산에 손해를 입힌 자에 관한 법 등을 율례로 주셨다. 종에 관한 법에는 종의 해방과 여종에 관한 법이 포함되었다. 사형 죄로는 타살, 부모 구타, 유괴, 부모 저주 등이 있었다. 그리고 손해 배상을 해야 할 죄로는 절도와 화재 등의 과실, 위탁물의 손상 및 차용물의 피해 등이 있었다.
  
  개인의 권리에 관한 법(21:1-21:36)    
 
  1. 너는 이 백성에게 다음과 같은 법을 공포하여라.
  2. '너희가 히브리 사람을 종으로 삼았을 경우에는 육 년 동안만 종으로 부리고 칠 년이 되면 보상 없이 자유를 주어 내보내라.
  3. 그가 홀몸으로 들어왔으면 홀몸으로 내보내고, 아내를 데리고 왔으면 아내를 데리고 나가게 하여라.
  4. 주인이 장가를 들여 그 아내가 아들이나 딸을 낳았을 경우에는 그 아내와 자식들은 주인의 것이므로 저 혼자 나가야 한다.
  5. 그러나 만일 그 종이, 자기는 주인과 자기 처자식을 사랑하므로 자유로운 몸이 되어 혼자 나가고 싶지 않다고 분명히 말하면,
  1. "Now these are the ordinances which you are to set before them:
  2. "If you buy a Hebrew slave, he shall serve for six years; but on the seventh he shall go out as a free man without payment.
  3. "If he comes alone, he shall go out alone; if he is the husband of a wife, then his wife shall go out with him.
  4. "If his master gives him a wife, and she bears him sons or daughters, the wife and her children shall belong to her master, and he shall go out alone.
  5. "But if the slave plainly says, 'I love my master, my wife and my children; I will not go out as a free man,'
  1. 주인은 그를 하느님 앞으로 데리고 가서 그의 귓바퀴를 문짝이나 문설주에 대고 송곳으로 뚫어라. 그러면 그는 죽을 때까지 그의 종이 된다.
  2. 남의 딸을 종으로 샀을 경우에는 남종을 내보내듯이 보내지는 못한다.
  3. 주인이 데리고 살려고 했는데 눈에 들지 않거든 몸값을 치르고 내보내라. 그는 약속을 어겼으므로 그 여종을 외국인에게 팔 권리가 없다.
  4. 만일 그를 며느리로 삼으려면, 딸에게 해주는 관습대로 해주어야 한다.
  5. 또 다른 여인을 맞아들이더라도 그 여종이 먹고 입을 것을 대주지 않거나 동거 생활을 중단하지는 못한다.
  1. then his master shall bring him to God, then he shall bring him to the door or the doorpost. And his master shall pierce his ear with an awl; and he shall serve him permanently.
  2. "If a man sells his daughter as a female slave, she is not to go free as the male slaves do.
  3. "If she is displeasing in the eyes of her master who designated her for himself, then he shall let her be redeemed. He does not have authority to sell her to a foreign people because of his unfairness to her.
  4. "If he designates her for his son, he shall deal with her according to the custom of daughters.
  5. "If he takes to himself another woman, he may not reduce her food, her clothing, or her conjugal rights.
  1. 주인이 이 세 가지 의무를 다하지 않으면, 여종은 몸값을 치르지 않고도 나갈 수 있다.
  2. 남을 때려죽인 자는 반드시 사형에 처하여야 한다.
  3. 만일 일부러 죽인 것이 아니고, 하느님이 그를 그의 손에 넘겨주어 그리 된 것이면 그런 사람이 피신할 곳은 내가 정하여 주리라.
  4. 그러나 누구든지 악의로 흉계를 꾸며 이웃을 죽였을 경우에는 그가 나의 제단을 붙잡았더라도 끌어내어 죽여야 한다.
  5. 부모를 때린 자는 반드시 사형에 처하여야 한다.
  1. "If he will not do these three things for her, then she shall go out for nothing, without payment of money.
  2. "He who strikes a man so that he dies shall surely be put to death.
  3. "But if he did not lie in wait for him, but God let him fall into his hand, then I will appoint you a place to which he may flee.
  4. "If, however, a man acts presumptuously toward his neighbor, so as to kill him craftily, you are to take him even from My altar, that he may die.
  5. "He who strikes his father or his mother shall surely be put to death.
  1. 유괴범은 유괴한 사람을 팔아버렸든 잡아두었든 간에 반드시 사형에 처하여야 한다.
  2. 부모를 업신여기는 자는 반드시 사형에 처하여야 한다.
  3. 서로 싸우다가 어느 한쪽이 상대편을 돌이나 주먹으로 때려, 맞은 사람이 죽지 않고 병석에 눕게 되었을 경우
  4. 그 맞은 사람이 다시 지팡이라도 짚고 나다니게 되면 때린 사람은 체형은 면하나, 그 동안의 치료비와 생활비를 물어주어야 한다.
  5. 자기 남종이나 여종을 때려 당장에 숨지게 한 자는 반드시 벌을 받아야 한다.
  1. "He who kidnaps a man, whether he sells him or he is found in his possession, shall surely be put to death.
  2. "He who curses his father or his mother shall surely be put to death.
  3. "If men have a quarrel and one strikes the other with a stone or with his fist, and he does not die but remains in bed,
  4. if he gets up and walks around outside on his staff, then he who struck him shall go unpunished; he shall only pay for his loss of time, and shall take care of him until he is completely healed.
  5. "If a man strikes his male or female slave with a rod and he dies at his hand, he shall be punished.
  1. 다만 그 종이 하루나 이틀만 더 살아 있어도 벌을 면한다. 종은 주인의 재산이기 때문이다.
  2. 사람들이 싸우다가 임신한 여인을 밀쳐서 낙태시켰을 경우, 다른 사고만 없으면 그 여인의 남편이 요구하는 배상액을 재판관의 조정 하에 지불해야 한다.
  3. 그러나 다른 사고가 생겨 목숨을 앗았으면 제 목숨으로 갚아야 한다.
  4. 눈은 눈으로, 이는 이로, 손은 손으로, 발은 발로,
  5. 화상은 화상으로, 상처는 상처로, 멍은 멍으로 갚아야 한다.
  1. "If, however, he survives a day or two, no vengeance shall be taken; for he is his property.
  2. "If men struggle with each other and strike a woman with child so that she gives birth prematurely, yet there is no injury, he shall surely be fined as the woman's husband may demand of him, and he shall pay as the judges decide.
  3. "But if there is any further injury, then you shall appoint as a penalty life for life,
  4. eye for eye, tooth for tooth, hand for hand, foot for foot,
  5. burn for burn, wound for wound, bruise for bruise.
  1. 자기 남종이나 여종의 눈을 때려 멀게 했으면 그 눈 대신에 종에게 자유를 주어 내보내야 한다.
  2. 또 자기 남종이나 여종의 이를 때려 부러뜨렸으면 그 이 대신에 종에게 자유를 주어 내보내야 한다.
  3. 황소가 남자든 여자든 사람을 뿔로 받아 죽였을 경우에는 그 황소를 돌로 쳐죽여야 한다. 그 고기는 먹지 못한다. 그러나 황소의 임자에게는 죄가 없다.
  4. 만일 그 황소가 본래 받는 버릇이 있어 그 임자에게 주의를 주었는데도 잘 지키지 않았기 때문에 남자든 여자든 사람을 받아 죽였을 경우에는 황소만 돌로 쳐죽일 것이 아니라 그 임자도 죽여야 한다.
  5. 만일 보상금을 요구해 오면 목숨 값으로 요구하는 보상금을 다 물어야 한다.
  1. "If a man strikes the eye of his male or female slave, and destroys it, he shall let him go free on account of his eye.
  2. "And if he knocks out a tooth of his male or female slave, he shall let him go free on account of his tooth.
  3. "If an ox gores a man or a woman to death, the ox shall surely be stoned and its flesh shall not be eaten; but the owner of the ox shall go unpunished.
  4. "If, however, an ox was previously in the habit of goring and its owner has been warned, yet he does not confine it and it kills a man or a woman, the ox shall be stoned and its owner also shall be put to death.
  5. "If a ransom is demanded of him, then he shall give for the redemption of his life whatever is demanded of him.
  1. 황소가 남의 아들이나 딸을 받았을 경우에도 이와 꼭 같은 법이 적용된다.
  2. 황소가 남의 남종이나 여종을 받았으면 그 종의 주인에게 은 삼십 세겔을 물어주고 황소는 돌로 쳐죽여야 한다.
  3. 누구든지 물웅덩이를 열어두거나 물웅덩이를 파고 덮지 않아서 황소나 나귀가 거기에 빠졌을 경우에는,
  4. 그 물웅덩이의 임자가 짐승의 임자에게 돈으로 보상해야 한다. 그 대신 죽은 짐승은 그의 것이 된다.
  5. 어떤 사람의 황소가 이웃집 황소를 받아서 죽였을 경우에는 산 황소를 팔아서 그 돈을 나누어가지고, 죽은 황소도 나누어가져야 한다.
  1. "Whether it gores a son or a daughter, it shall be done to him according to the same rule.
  2. "If the ox gores a male or female slave, the owner shall give his or her master thirty shekels of silver, and the ox shall be stoned.
  3. "If a man opens a pit, or digs a pit and does not cover it over, and an ox or a donkey falls into it,
  4. the owner of the pit shall make restitution; he shall give money to its owner, and the dead animal shall become his.
  5. "If one man's ox hurts another's so that it dies, then they shall sell the live ox and divide its price equally; and also they shall divide the dead ox.
  1. 만일 임자가 잘 지키지 않았을 경우에는 산 황소를 대신 주고 죽은 황소를 가져야 한다.
  1. "Or if it is known that the ox was previously in the habit of goring, yet its owner has not confined it, he shall surely pay ox for ox, and the dead animal shall become his.
 
  손해 배상에 관한 법(22:1-22:15)    
 
  1. 도둑이 집을 뚫고 들어오는 것을 보고 때려죽였을 경우에는 그 사람에게 죄가 없다.
  2. 그러나 해가 이미 떠오른 후에 그런 일이 생겼으면 죽인 사람에게 책임이 있다. 훔친 것은 반드시 다 갚아야 한다. 갚을 것이 없는 자는 제 몸을 팔아서라도 훔친 물건의 값을 물어주어야 한다.
  3. 훔친 물건이 황소든 나귀든 양이든 아직 산 채로 그의 수중에 있으면 그것을 갑절로 배상해야 한다.
  4. 자기 밭이나 포도원에서 풀을 뜯기던 가축을 풀어놓아 남의 밭 곡식을 뜯어먹게 하였을 경우에는 그 밭의 소출을 보상해야 한다. 밭곡식을 모두 뜯어먹었을 경우에는 자기 밭에서 제일 좋은 소출과 자기 포도원에서 제일 좋은 소출을 거두어 배상해야 한다.
  5. 불이 나서 가시덤불에 당겨 남의 낟가리나 베지 않은 곡식이나 남의 밭을 태웠을 경우에는, 불을 낸 자가 그것을 모두 배상해야 한다.
  1. "If a man steals an ox or a sheep and slaughters it or sells it, he shall pay five oxen for the ox and four sheep for the sheep.
  2. "If the thief is caught while breaking in and is struck so that he dies, there will be no bloodguiltiness on his account.
  3. "But if the sun has risen on him, there will be bloodguiltiness on his account. He shall surely make restitution; if he owns nothing, then he shall be sold for his theft.
  4. "If what he stole is actually found alive in his possession, whether an ox or a donkey or a sheep, he shall pay double.
  5. "If a man lets a field or vineyard be grazed bare and lets his animal loose so that it grazes in another man's field, he shall make restitution from the best of his own field and the best of his own vineyard.
  1. 어떤 사람이 자기 이웃에게 돈이나 물건을 맡겼다가 그 집에서 도둑을 맞았을 경우, 그 도둑이 잡히면 그에게서 갑절로 배상을 받는다.
  2. 그러나 도둑이 잡히지 않았을 경우에는 그 집 주인이 하느님 앞에 가서, 이웃 사람의 물건에 손을 대지 않았음을 맹세해야 한다.
  3. 소나 나귀나 양이나 겉옷이나 그 밖에 무엇을 잃어버렸든지 간에 잃은 사람이 누구의 것을 보고 그것이 바로 자기의 것이라고 나서면, 이 두 사람의 소송은 하느님께 판결을 받아야 한다. 하느님께 패소 판결을 받은 쪽이 상대방에게 갑절로 배상해야 한다.
  4. 어떤 사람이 자기 이웃에게 나귀나 소나 양이나 그 밖에 어떤 가축이든 간에 지켜달라고 맡겼다가, 그것이 죽거나 다리가 부러졌거나 아무도 모르게 끌려갔을 경우에는
  5. 맡았던 사람이 이웃의 물건에 손을 대지 않았음을 야훼 앞에서 맹세하는 것으로 두 사람 사이의 시비를 가려야 한다. 임자는 남은 것만 받고 배상은 받지 못한다.
  1. "If a fire breaks out and spreads to thorn bushes, so that stacked grain or the standing grain or the field itself is consumed, he who started the fire shall surely make restitution.
  2. "If a man gives his neighbor money or goods to keep for him and it is stolen from the man's house, if the thief is caught, he shall pay double.
  3. "If the thief is not caught, then the owner of the house shall appear before the judges, to determine whether he laid his hands on his neighbor's property.
  4. "For every breach of trust, whether it is for ox, for donkey, for sheep, for clothing, or for any lost thing about which one says, 'This is it,' the case of both parties shall come before the judges; he whom the judges condemn shall pay double to his neighbor.
  5. "If a man gives his neighbor a donkey, an ox, a sheep, or any animal to keep for him, and it dies or is hurt or is driven away while no one is looking,
  1. 그러나 맡았던 것이 자기 집에서 도둑 맞았음이 확실하면 임자에게 배상해 주어야 한다.
  2. 만일 그것이 짐승에게 찢겨 죽은 경우에는 그 증거물을 가져다 보이고 그 찢겨 죽은 것은 보상하지 않아도 된다.
  3. 어떤 사람이 이웃에게서 짐승을 빌려왔다가 다리가 부러졌거나 죽었을 경우에는, 그 임자가 같이 있지 않았다면 반드시 보상하여야 한다.
  4. 임자가 부리다가 그렇게 되었으면 보상하지 않아도 된다. 임자가 품을 팔다가 그렇게 되었으면 품값은 계산해 주어야 한다.
  5. 어떤 사람이 아직 약혼하지 않은 처녀를 꾀어 범했을 경우에는 납폐금을 모두 지불하고, 그 처녀를 아내로 맞아들여야 한다.
  1. an oath before the LORD shall be made by the two of them that he has not laid hands on his neighbor's property; and its owner shall accept it, and he shall not make restitution.
  2. "But if it is actually stolen from him, he shall make restitution to its owner.
  3. "If it is all torn to pieces, let him bring it as evidence; he shall not make restitution for what has been torn to pieces.
  4. "If a man borrows anything from his neighbor, and it is injured or dies while its owner is not with it, he shall make full restitution.
  5. "If its owner is with it, he shall not make restitution; if it is hired, it came for its hire.
