	신명기 19:15-21:23 모세는 증언의 중요성을 강조하여, 거짓 증언을 하는 자는 가차없이 처벌할 것을 명했다. 이스라엘이 가나안 본토 이외의 지역에서 전쟁을 수행할 때는 먼저 적군에게 평화를 청하여 조공을 요구하고 이를 거부할 경우 진멸시키라고 명했으며, 가해자를 모르는 살인 사건이 발생했을 경우의 속죄 규례와 장자 상속권의 보호 그리고 불효자의 징계를 명령했다.

	증인에 관한 규례(19:15-19:21)

사람의 모든 악에 관하여 또한 모든 죄에 관하여는 한 증인으로만 정할 것이 아니요 두 증인의 입으로나 또는 세 증인의 입으로 그 사건을 확정할 것이며

만일 위증하는 자가 있어 어떤 사람이 악을 행하였다고 말하면

그 논쟁하는 쌍방이 같이 하나님 앞에 나아가 그 당시의 제사장과 재판장 앞에 설 것이요

재판장은 자세히 조사하여 그 증인이 거짓 증거하여 그 형제를 거짓으로 모함한 것이 판명되면

그가 그의 형제에게 행하려고 꾀한 그대로 그에게 행하여 너희 중에서 악을 제하라

One witness shall not rise up against a man for any iniquity, or for any sin, in any sin that he sinneth: at the mouth of two witnesses, or at the mouth of three witnesses, shall the matter be established.

If a false witness rise up against any man to testify against him that which is wrong;

Then both the men, between whom the controversy is, shall stand before the LORD, before the priests and the judges, which shall be in those days;

And the judges shall make diligent inquisition: and, behold, if the witness be a false witness, and hath testified falsely against his brother;

Then shall ye do unto him, as he had thought to have done unto his brother: so shalt thou put the evil away from among you.

그리하면 그 남은 자들이 듣고 두려워하여 다시는 그런 악을 너희 중에서 행하지 아니하리라

네 눈이 긍휼히 여기지 말라 생명에는 생명으로, 눈에는 눈으로, 이에는 이로, 손에는 손으로, 발에는 발로이니라

And those which remain shall hear, and fear, and shall henceforth commit no more any such evil among you.

And thine eye shall not pity; but life shall go for life, eye for eye, tooth for tooth, hand for hand, foot for foot.

	전쟁시 유의 사항(20:1-20:20)

네가 나가서 적군과 싸우려 할 때에 말과 병거와 백성이 너보다 많음을 볼지라도 그들을 두려워하지 말라 애굽 땅에서 너를 인도하여 내신 네 하나님 여호와께서 너와 함께 하시느니라

너희가 싸울 곳에 가까이 가면 제사장은 백성에게 나아가서 고하여 그들에게

말하여 이르기를 이스라엘아 들으라 너희가 오늘 너희의 대적과 싸우려고 나아왔으니 마음에 겁내지 말며 두려워하지 말며 떨지 말며 그들로 말미암아 놀라지 말라

너희 하나님 여호와는 너희와 함께 행하시며 너희를 위하여 너희 적군과 싸우시고 구원하실 것이라 할 것이며

책임자들은 백성에게 말하여 이르기를 새 집을 건축하고 낙성식을 행하지 못한 자가 있느냐 그는 집으로 돌아갈지니 전사하면 타인이 낙성식을 행할까 하노라

When thou goest out to battle against thine enemies, and seest horses, and chariots, and a people more than thou, be not afraid of them: for the LORD thy God is with thee, which brought thee up out of the land of Egypt.

And it shall be, when ye are come nigh unto the battle, that the priest shall approach and speak unto the people,

And shall say unto them, Hear, O Israel, ye approach this day unto battle against your enemies: let not your hearts faint, fear not, and do not tremble, neither be ye terrified because of them;

For the LORD your God is he that goeth with you, to fight for you against your enemies, to save you.

And the officers shall speak unto the people, saying, What man is there that hath built a new house, and hath not dedicated it? let him go and return to his house, lest he die in the battle, and another man dedicate it.

포도원을 만들고 그 과실을 먹지 못한 자가 있느냐 그는 집으로 돌아갈지니 전사하면 타인이 그 과실을 먹을까 하노라

여자와 약혼하고 그와 결혼하지 못한 자가 있느냐 그는 집으로 돌아갈지니 전사하면 타인이 그를 데려갈까 하노라 하고

책임자들은 또 백성에게 말하여 이르기를 두려워서 마음이 허약한 자가 있느냐 그는 집으로 돌아갈지니 그의 형제들의 마음도 그의 마음과 같이 낙심될까 하노라 하고

백성에게 이르기를 마친 후에 군대의 지휘관들을 세워 무리를 거느리게 할지니라

네가 어떤 성읍으로 나아가서 치려 할 때에는 그 성읍에 먼저 화평을 선언하라

And what man is he that hath planted a vineyard, and hath not yet eaten of it? let him also go and return unto his house, lest he die in the battle, and another man eat of it.

And what man is there that hath betrothed a wife, and hath not taken her? let him go and return unto his house, lest he die in the battle, and another man take her.

And the officers shall speak further unto the people, and they shall say, What man is there that is fearful and fainthearted? let him go and return unto his house, lest his brethren's heart faint as well as his heart.

And it shall be, when the officers have made an end of speaking unto the people that they shall make captains of the armies to lead the people.

When thou comest nigh unto a city to fight against it, then proclaim peace unto it.

그 성읍이 만일 화평하기로 회답하고 너를 향하여 성문을 열거든 그 모든 주민들에게 네게 조공을 바치고 너를 섬기게 할 것이요

만일 너와 화평하기를 거부하고 너를 대적하여 싸우려 하거든 너는 그 성읍을 에워쌀 것이며

네 하나님 여호와께서 그 성읍을 네 손에 넘기시거든 너는 칼날로 그 안의 남자를 다 쳐죽이고

너는 오직 여자들과 유아들과 가축들과 성읍 가운데에 있는 모든 것을 너를 위하여 탈취물로 삼을 것이며 너는 네 하나님 여호와께서 네게 주신 적군에게서 빼앗은 것을 먹을지니라

네가 네게서 멀리 떠난 성읍들 곧 이 민족들에게 속하지 아니한 성읍들에게는 이같이 행하려니와

And it shall be, if it make thee answer of peace, and open unto thee, then it shall be, that all the people that is found therein shall be tributaries unto thee, and they shall serve thee.

And if it will make no peace with thee, but will make war against thee, then thou shalt besiege it:

And when the LORD thy God hath delivered it into thine hands, thou shalt smite every male thereof with the edge of the sword:

But the women, and the little ones, and the cattle, and all that is in the city, even all the spoil thereof, shalt thou take unto thyself; and thou shalt eat the spoil of thine enemies, which the LORD thy God hath given thee.

Thus shalt thou do unto all the cities which are very far off from thee, which are not of the cities of these nations.

오직 네 하나님 여호와께서 네게 기업으로 주시는 이 민족들의 성읍에서는 호흡 있는 자를 하나도 살리지 말지니

곧 헷 족속과 아모리 족속과 가나안 족속과 브리스 족속과 히위 족속과 여부스 족속을 네가 진멸하되 네 하나님 여호와께서 네게 명령하신 대로 하라

이는 그들이 그 신들에게 행하는 모든 가증한 일을 너희에게 가르쳐 본받게 하여 너희가 너희의 하나님 여호와께 범죄하게 할까 함이니라

너희가 어떤 성읍을 오랫동안 에워싸고 그 성읍을 쳐서 점령하려 할 때에도 도끼를 둘러 그 곳의 나무를 찍어내지 말라 이는 너희가 먹을 것이 될 것임이니 찍지 말라 들의 수목이 사람이냐 너희가 어찌 그것을 에워싸겠느냐

다만 과목이 아닌 수목은 찍어내어 너희와 싸우는 그 성읍을 치는 기구를 만들어 그 성읍을 함락시킬 때까지 쓸지니라

But of the cities of these people, which the LORD thy God doth give thee for an inheritance, thou shalt save alive nothing that breatheth:

But thou shalt utterly destroy them; namely, the Hittites, and the Amorites, the Canaanites, and the Perizzites, the Hivites, and the Jebusites; as the LORD thy God hath commanded thee:

That they teach you not to do after all their abominations, which they have done unto their gods; so should ye sin against the LORD your God.

When thou shalt besiege a city a long time, in making war against it to take it, thou shalt not destroy the trees thereof by forcing an axe against them: for thou mayest eat of them, and thou shalt not cut them down (for the tree of the field is man's life) to employ them in the siege:

Only the trees which thou knowest that they be not trees for meat, thou shalt destroy and cut them down; and thou shalt build bulwarks against the city that maketh war with thee, until it be subdued.

	살인과 가정 문제(21:1-21:23)

네 하나님 여호와께서 네게 주어 차지하게 하신 땅에서 피살된 시체가 들에 엎드러진 것을 발견하고 그 쳐죽인 자가 누구인지 알지 못하거든

너희의 장로들과 재판장들은 나가서 그 피살된 곳의 사방에 있는 성읍의 원근을 잴 것이요

그 피살된 곳에서 제일 가까운 성읍의 장로들이 그 성읍에서 아직 부리지 아니하고 멍에를 메지 아니한 암송아지를 취하여

그 성읍의 장로들이 물이 항상 흐르고 갈지도 않고 씨를 뿌린 일도 없는 골짜기로 그 송아지를 끌고 가서 그 골짜기에서 그 송아지의 목을 꺾을 것이요

레위 자손 제사장들도 그리로 갈지니 그들은 네 하나님 여호와께서 택하사 자기를 섬기게 하시며 또 여호와의 이름으로 축복하게 하신 자라 모든 소송과 모든 투쟁이 그들의 말대로 판결될 것이니라

If one be found slain in the land which the LORD thy God giveth thee to possess it, lying in the field, and it be not known who hath slain him:

Then thy elders and thy judges shall come forth, and they shall measure unto the cities which are round about him that is slain:

And it shall be, that the city which is next unto the slain man, even the elders of that city shall take an heifer, which hath not been wrought with, and which hath not drawn in the yoke;

And the elders of that city shall bring down the heifer unto a rough valley, which is neither eared nor sown, and shall strike off the heifer's neck there in the valley:

And the priests the sons of Levi shall come near; for them the LORD thy God hath chosen to minister unto him, and to bless in the name of the LORD; and by their word shall every controversy and every stroke be tried:

그 피살된 곳에서 제일 가까운 성읍의 모든 장로들은 그 골짜기에서 목을 꺾은 암송아지 위에 손을 씻으며

말하기를 우리의 손이 이 피를 흘리지 아니하였고 우리의 눈이 이것을 보지도 못하였나이다

여호와여 주께서 속량하신 주의 백성 이스라엘을 사하시고 무죄한 피를 주의 백성 이스라엘 중에 머물러 두지 마옵소서 하면 그 피 흘린 죄가 사함을 받으리니

너는 이와 같이 여호와께서 보시기에 정직한 일을 행하여 무죄한 자의 피 흘린 죄를 너희 중에서 제할지니라

네가 나가서 적군과 싸울 때에 네 하나님 여호와께서 그들을 네 손에 넘기시므로 네가 그들을 사로잡은 후에

And all the elders of that city, that are next unto the slain man, shall wash their hands over the heifer that is beheaded in the valley:

And they shall answer and say, Our hands have not shed this blood, neither have our eyes seen it.

Be merciful, O LORD, unto thy people Israel, whom thou hast redeemed, and lay not innocent blood unto thy people of Israel's charge. And the blood shall be forgiven them.

So shalt thou put away the guilt of innocent blood from among you, when thou shalt do that which is right in the sight of the LORD.

When thou goest forth to war against thine enemies, and the LORD thy God hath delivered them into thine hands, and thou hast taken them captive,

네가 만일 그 포로 중의 아리따운 여자를 보고 그에게 연연하여 아내를 삼고자 하거든

그를 네 집으로 데려갈 것이요 그는 그 머리를 밀고 손톱을 베고

또 포로의 의복을 벗고 네 집에 살며 그 부모를 위하여 한 달 동안 애곡한 후에 네가 그에게로 들어가서 그의 남편이 되고 그는 네 아내가 될 것이요

그 후에 네가 그를 기뻐하지 아니하거든 그의 마음대로 가게 하고 결코 돈을 받고 팔지 말지라 네가 그를 욕보였은즉 종으로 여기지 말지니라

어떤 사람이 두 아내를 두었는데 하나는 사랑을 받고 하나는 미움을 받다가 그 사랑을 받는 자와 미움을 받는 자가 둘 다 아들을 낳았다 하자 그 미움을 받는 자의 아들이 장자이면

And seest among the captives a beautiful woman, and hast a desire unto her, that thou wouldest have her to thy wife;

Then thou shalt bring her home to thine house, and she shall shave her head, and pare her nails;

And she shall put the raiment of her captivity from off her, and shall remain in thine house, and bewail her father and her mother a full month: and after that thou shalt go in unto her, and be her husband, and she shall be thy wife.

And it shall be, if thou have no delight in her, then thou shalt let her go whither she will; but thou shalt not sell her at all for money, thou shalt not make merchandise of her, because thou hast humbled her.

If a man have two wives, one beloved, and another hated, and they have born him children, both the beloved and the hated; and if the firstborn son be hers that was hated:

자기의 소유를 그의 아들들에게 기업으로 나누는 날에 그 사랑을 받는 자의 아들을 장자로 삼아 참 장자 곧 미움을 받는 자의 아들보다 앞세우지 말고

반드시 그 미움을 받는 자의 아들을 장자로 인정하여 자기의 소유에서 그에게는 두 몫을 줄 것이니 그는 자기의 기력의 시작이라 장자의 권리가 그에게 있음이니라

사람에게 완악하고 패역한 아들이 있어 그의 아버지의 말이나 그 어머니의 말을 순종하지 아니하고 부모가 징계하여도 순종하지 아니하거든

그의 부모가 그를 끌고 성문에 이르러 그 성읍 장로들에게 나아가서

그 성읍 장로들에게 말하기를 우리의 이 자식은 완악하고 패역하여 우리 말을 듣지 아니하고 방탕하며 술에 잠긴 자라 하면

Then it shall be, when he maketh his sons to inherit that which he hath, that he may not make the son of the beloved firstborn before the son of the hated, which is indeed the firstborn:

But he shall acknowledge the son of the hated for the firstborn, by giving him a double portion of all that he hath: for he is the beginning of his strength; the right of the firstborn is his.

If a man have a stubborn and rebellious son, which will not obey the voice of his father, or the voice of his mother, and that, when they have chastened him, will not hearken unto them:

Then shall his father and his mother lay hold on him, and bring him out unto the elders of his city, and unto the gate of his place;

And they shall say unto the elders of his city, This our son is stubborn and rebellious, he will not obey our voice; he is a glutton, and a drunkard.

그 성읍의 모든 사람들이 그를 돌로 쳐죽일지니 이같이 네가 너희 중에서 악을 제하라 그리하면 온 이스라엘이 듣고 두려워하리라

사람이 만일 죽을 죄를 범하므로 네가 그를 죽여 나무 위에 달거든

그 시체를 나무 위에 밤새도록 두지 말고 그 날에 장사하여 네 하나님 여호와께서 네게 기업으로 주시는 땅을 더럽히지 말라 나무에 달린 자는 하나님께 저주를 받았음이니라

And all the men of his city shall stone him with stones, that he die: so shalt thou put evil away from among you; and all Israel shall hear, and fear.

And if a man have committed a sin worthy of death, and he be to be put to death, and thou hang him on a tree:

His body shall not remain all night upon the tree, but thou shalt in any wise bury him that day; (for he that is hanged is accursed of God;) that thy land be not defiled, which the LORD thy God giveth thee for an inheritance.
