출애굽기 21:1-22:15

 하나님께서는 백성들에게 종에 관한 법, 사형 죄에 관한 법, 그리고 사람이나 재산에 손해를 입힌 자에 관한 법 등을 율례로 주셨다. 종에 관한 법에는 종의 해방과 여종에 관한 법이 포함되었다. 사형 죄로는 타살, 부모 구타, 유괴, 부모 저주 등이 있었다. 그리고 손해 배상을 해야 할 죄로는 절도와 화재 등의 과실, 위탁물의 손상 및 차용물의 피해 등이 있었다.
  
  개인의 권리에 관한 법(21:1-21:36)    
 
  1. Now these are the judgments which thou shalt set before them.
  2. If thou buy an Hebrew servant, six years he shall serve: and in the seventh he shall go out free for nothing.
  3. If he came in by himself, he shall go out by himself: if he were married, then his wife shall go out with him.
  4. If his master have given him a wife, and she have born him sons or daughters; the wife and her children shall be her master's, and he shall go out by himself.
  5. And if the servant shall plainly say, I love my master, my wife, and my children; I will not go out free:
  1. '너희가 지켜야 할 법은 이렇다. :
  2. 만일 너희가 히브리 종을 사면 그는 6년 동안만 너희를 섬길 것이며 7년째에는 그가 몸값을 지불하지 않아도 자유로운 몸이 될 것이다.
  3. 그가 결혼하지 않고 홀몸으로 왔으면 홀몸으로 나가게 하고 종으로 팔려올 때 아내와 함께 왔으면 나갈 때 그의 아내도 함께 가게 하라.
  4. 만일 주인이 그에게 아내를 주어 그 여자가 자녀를 낳았으면 그 여자와 아이들은 주인의 소유가 될 것이며 나갈 때는 그 남자만 나가야 한다.
  5. 그러나 그 종이 주인과 자기 처자를 사랑하므로 혼자 나가서 자유로운 몸이 되고 싶지 않다고 말하면
  1. Then his master shall bring him unto the judges; he shall also bring him to the door, or unto the door post; and his master shall bore his ear through with an aul; and he shall serve him for ever.
  2. And if a man sell his daughter to be a maidservant, she shall not go out as the menservants do.
  3. If she please not her master, who hath betrothed her to himself, then shall he let her be redeemed: to sell her unto a strange nation he shall have no power, seeing he hath dealt deceitfully with her.
  4. And if he have betrothed her unto his son, he shall deal with her after the manner of daughters.
  5. If he take him another wife; her food, her raiment, and her duty of marriage, shall he not diminish.
  1. 주인은 그를 재판관 앞에 데리고 가서 그를 문이나 문설주에 기대 서게 하고 송곳으로 그 귀를 뚫어야 한다. 그러면 그가 평생 그의 종이 될 것이다.
  2. 만일 사람이 자기 딸을 종으로 팔면 그녀는 남자 종처럼 자유로운 몸으로 나갈 수 없다.
  3. 만일 그 여자가 자기를 아내로 삼고자 하는 사람에게 팔렸으나 그녀를 산 주인이 그녀를 좋아하지 않으면 주인은 그녀가 다시 팔려갈 수 있게 해야 한다. 그러나 주인은 그녀와의 신의를 저버렸으므로 그녀를 외국인에게 팔 권리가 없다.
  4. 또 주인이 자기 아들의 아내를 삼기 위해서 여종을 샀으면 주인은 그 여종에게 딸과 동등한 대우를 해야 한다.
  5. 그가 또 다른 여자와 결혼하게 되면 그는 전처에게 의복과 음식을 제공하고 부부 관계를 소홀히 해서는 안 된다.
  1. And if he do not these three unto her, then shall she go out free without money.
  2. He that smiteth a man, so that he die, shall be surely put to death.
  3. And if a man lie not in wait, but God deliver him into his hand; then I will appoint thee a place whither he shall flee.
  4. But if a man come presumptuously upon his neighbour, to slay him with guile; thou shalt take him from mine altar, that he may die.
  5. And he that smiteth his father, or his mother, shall be surely put to death.
  1. 만일 그가 의복과 음식과 부부 관계, 이 세 가지 일을 이행하지 않으면 그 여종은 몸값을 지불하지 않고서도 자유로운 몸이 되어 나갈 수 있다.'
  2. 사람을 쳐서 죽인 자는 반드시 죽여라.
  3. 만일 누가 고의성이 없는 우발적인 사고로 사람을 죽이면 그는 내가 정한 곳으로 피신할 수 있다.
  4. 그러나 계획적으로 다른 사람을 죽인 자는 내 단으로 피신했을지라도 그를 끌어내어 죽여라.
  5. 자기 아버지나 어머니를 치는 자는 반드시 죽여라.
  1. And he that stealeth a man, and selleth him, or if he be found in his hand, he shall surely be put to death.
  2. And he that curseth his father, or his mother, shall surely be put to death.
  3. And if men strive together, and one smite another with a stone, or with his fist, and he die not, but keepeth his bed:
  4. If he rise again, and walk abroad upon his staff, then shall he that smote him be quit: only he shall pay for the loss of his time, and shall cause him to be thoroughly healed.
  5. And if a man smite his servant, or his maid, with a rod, and he die under his hand; he shall be surely punished.
  1. 누구든지 사람을 유괴하면 그 사람을 팔았든지 자기가 데리고 있든지 그 유괴범을 반드시 죽여라.
  2. 자기 아버지나 어머니를 저주하는 자는 반드시 죽여라.
  3. 만일 사람이 서로 싸우다가 한 사람이 돌이나 주먹으로 상대방을 쳤으나 그가 죽지 않고 자리에 누웠다가
  4. 후에 일어나서 지팡이를 짚고 걸어다닐 수 있으면 그를 친 사람이 형벌은 면할 수 있다. 그러나 그는 피해자에게 그 동안의 손해를 보상해 주고 그가 완치될 때까지 치료비를 부담해야 한다.
  5. 어떤 사람이 남종이든 여종이든 매로 자기 종을 쳐서 그 종이 당장 죽으면 그는 반드시 형벌을 받아야 한다.
  1. Notwithstanding, if he continue a day or two, he shall not be punished: for he is his money.
  2. If men strive, and hurt a woman with child, so that her fruit depart from her, and yet no mischief follow: he shall be surely punished, according as the woman's husband will lay upon him; and he shall pay as the judges determine.
  3. And if any mischief follow, then thou shalt give life for life,
  4. Eye for eye, tooth for tooth, hand for hand, foot for foot,
  5. Burning for burning, wound for wound, stripe for stripe.
  1. 그러나 그 종이 하루나 이틀 안에 죽지 않으면 그는 형벌을 받지 않아도 된다. 이것은 종이 주인의 재산이기 때문이다.
  2. 사람들이 서로 싸우다가 임신한 여자를 다치게 하여 낙태하게 하였으나 다른 상처가 없으면 가해자는 그 여자의 남편이 요구하는 대로 피해 보상을 하되 반드시 재판관의 승인을 받아야 한다.
  3. 그러나 그 여자가 다른 상처를 입었으면 생명은 생명으로,
  4. 눈은 눈으로, 이는 이로, 손은 손으로, 발은 발로,
  5. 화상은 화상으로, 상처는 상처로, 타박상은 타박상으로 갚아라.
  1. And if a man smite the eye of his servant, or the eye of his maid, that it perish; he shall let him go free for his eye's sake.
  2. And if he smite out his manservant's tooth, or his maidservant's tooth; he shall let him go free for his tooth's sake.
  3. If an ox gore a man or a woman, that they die: then the ox shall be surely stoned, and his flesh shall not be eaten; but the owner of the ox shall be quit.
  4. But if the ox were wont to push with his horn in time past, and it hath been testified to his owner, and he hath not kept him in, but that he hath killed a man or a woman; the ox shall be stoned, and his owner also shall be put to death.
  5. If there be laid on him a sum of money, then he shall give for the ransom of his life whatsoever is laid upon him.
  1. 어떤 사람이 자기 남종이나 여종의 눈을 쳐서 못 쓰게 하면 그 눈에 대한 보상으로 그 종을 자유롭게 놓아 주어야 하며
  2. 만일 남종이나 여종의 이를 쳐서 부러뜨리면 그는 그 이에 대한 보상으로 그 종을 자유롭게 놓아 주어야 한다.'
  3. '만일 소가 사람을 들이받아 죽이면 그 소는 반드시 돌로 쳐죽이고 그 고기는 먹지 말아라. 이럴 경우 그 소의 임자는 형벌을 받지 않아도 된다.
  4. 그러나 그 소가 들이받는 버릇이 있어 그 임자가 경고를 받고도 소를 단속하지 않아 사람을 받아 죽였으면 그 소를 돌로 쳐 죽이고 그 소의 임자도 죽여라.
  5. 그렇지만 피해자 측에서 보상금을 요구하면 그는 그 보상금을 지불하고 자기 생명을 구할 수 있다.
  1. Whether he have gored a son, or have gored a daughter, according to this judgment shall it be done unto him.
  2. If the ox shall push a manservant or a maidservant; he shall give unto their master thirty shekels of silver, and the ox shall be stoned.
  3. And if a man shall open a pit, or if a man shall dig a pit, and not cover it, and an ox or an ass fall therein;
  4. The owner of the pit shall make it good, and give money unto the owner of them; and the dead beast shall be his.
  5. And if one man's ox hurt another's, that he die; then they shall sell the live ox, and divide the money of it; and the dead ox also they shall divide.
  1. 이 법은 소가 나이 어린 아이들을 들이받아 죽였을 경우에도 동일하게 적용된다.
  2. 만일 소가 남종이든 여종이든 남의 종을 들이받아 죽이면 소 임자는 그 종의 주인에게 은 약 340그램을 주어야 하며 그 소는 돌로 쳐죽여야 한다.
  3. 어떤 사람이 구덩이를 열어 두거나 구덩이를 파고 덮지 않아 소나 나귀가 거기에 빠지면
  4. 그 구덩이 주인은 짐승 임자에게 손해 배상을 해야 한다. 이럴 경우 죽은 짐승은 그의 것이다.
  5. 어떤 사람의 소가 다른 사람의 소를 들이받아 죽이면 두 사람은 산 소를 팔아 그 값을 반반씩 나누고 죽은 소도 똑같이 나누어라.
  1. Or if it be known that the ox hath used to push in time past, and his owner hath not kept him in; he shall surely pay ox for ox; and the dead shall be his own.
  1. 그러나 그 소가 본래 들이받는 버릇이 있는 줄을 알고도 소 임자가 소를 단속하지 않았으면 그는 산 소로 그 손해를 배상해 주어야 한다. 이럴 경우 죽은 소는 그의 것이다.'
 
  손해 배상에 관한 법(22:1-22:15)    
 
  1. If a man shall steal an ox, or a sheep, and kill it, or sell it; he shall restore five oxen for an ox, and four sheep for a sheep.
  2. If a thief be found breaking up, and be smitten that he die, there shall no blood be shed for him.
  3. If the sun be risen upon him, there shall be blood shed for him; for he should make full restitution; if he have nothing, then he shall be sold for his theft.
  4. If the theft be certainly found in his hand alive, whether it be ox, or ass, or sheep; he shall restore double.
  5. If a man shall cause a field or vineyard to be eaten, and shall put in his beast, and shall feed in another man's field; of the best of his own field, and of the best of his own vineyard, shall he make restitution.
  1. '어떤 사람이 남의 소나 양을 도둑질하여 그것을 잡거나 팔면 그는 소 한 마리에 소 다섯 마리로 배상하고 양 한 마리에 대해서는 양 네 마리로 배상해야 한다.
  2. 도둑이 뚫고 들어오는 것을 보고 그를 쳐죽여도 아무 죄가 없다.
  3. 그러나 해가 돋은 이후에 그런 일이 일어나면 그것은 살인죄가 된다. '도둑은 훔친 것에 대해서 반드시 배상해야 하며 그가 가진 것이 아무 것도 없을 때에는 자기 몸을 팔아서라도 도둑질한 것을 배상해야 한다.
  4. 만일 도둑질 한 짐승을 산 채로 소유하고 있으면 그것이 소든 나귀든 양이든 두 배로 배상해 주어야 한다.
  5. 어떤 사람이 자기 짐승을 잘 단속하지 않아 그것이 남의 밭이나 포도원을 해치면 자기 밭이나 포도원의 제일 좋은 농산물로 그 피해를 배상해 주어야 한다.
  1. If fire break out, and catch in thorns, so that the stacks of corn, or the standing corn, or the field, be consumed therewith; he that kindled the fire shall surely make restitution.
  2. If a man shall deliver unto his neighbour money or stuff to keep, and it be stolen out of the man's house; if the thief be found, let him pay double.
  3. If the thief be not found, then the master of the house shall be brought unto the judges, to see whether he have put his hand unto his neighbour's goods.
  4. For all manner of trespass, whether it be for ox, for ass, for sheep, for raiment, or for any manner of lost thing which another challengeth to be his, the cause of both parties shall come before the judges; and whom the judges shall condemn, he shall pay double unto his neighbour.
  5. If a man deliver unto his neighbour an ass, or an ox, or a sheep, or any beast, to keep; and it die, or be hurt, or driven away, no man seeing it:
  1. 만일 누가 밭에 불을 놓았는데 그 불이 걷잡을 수 없이 번져 남의 밭에 있는 곡식이나 베어 둔 낟가리나 밭 전체를 몽땅 태우면 불을 놓은 사람은 반드시 그 손해를 배상해야 한다.
  2. 어떤 사람이 돈이나 물품을 보관해 달라고 자기 이웃에게 맡겼는데 그것이 도둑을 맞았을 경우 도둑이 잡히면 그 도둑은 두 배로 배상해 주어야 한다.
  3. 그러나 그 도둑이 잡히지 않으면 그 집 주인은 재판관 앞에 가서 자기 이웃의 물건에 손을 댔는지 대지 않았는지 조사를 받아야 한다.
  4. 소나 나귀나 양이나 의복이나 그 밖의 분실한 물건에 대해서 소유권 문제로 시비가 생기면 쌍방은 재판관 앞에 갈 것이며 재판관이 죄가 있다고 선언한 사람은 상대방에게 두 배로 배상해야 한다.
  5. 어떤 사람이 나귀나 소나 양이나 그 밖의 다른 짐승을 좀 봐 달라고 자기 이웃에게 맡겼는데 그것이 죽거나 상처를 입거나 없어져도 그것을 목격한 증인이 없으면
  1. Then shall an oath of the LORD be between them both, that he hath not put his hand unto his neighbour's goods; and the owner of it shall accept thereof, and he shall not make it good.
  2. And if it be stolen from him, he shall make restitution unto the owner thereof.
  3. If it be torn in pieces, then let him bring it for witness, and he shall not make good that which was torn.
  4. And if a man borrow ought of his neighbour, and it be hurt, or die, the owner thereof being not with it, he shall surely make it good.
  5. But if the owner thereof be with it, he shall not make it good: if it be an hired thing, it came for his hire.
  1. 그것을 맡은 사람은 자기 이웃의 짐승에 손을 대지 않았다고 여호와 앞에서 맹세해야 할 것이며 짐승 임자는 그대로 믿어야 한다. 이럴 경우 그 짐승을 맡았던 사람은 그것을 배상하지 않아도 된다.
  2. 그러나 그 짐승이 도둑을 맞았으면 그것을 맡은 사람이 그 임자에게 배상할 것이며
  3. 만일 그 짐승이 맹수에게 찢겨 죽었으면 그 증거물을 가져와 제시해야 한다. 이럴 경우 그 짐승을 맡은 사람은 배상하지 않아도 된다.
  4. 어떤 사람이 자기 이웃에게 짐승을 빌려 왔는데 임자가 없는 동안에 그 짐승이 상처를 입거나 죽으면 그는 그 손해를 반드시 배상해야 한다.
  5. 그러나 그 임자가 짐승과 함께 있을 때 그런 일이 일어나면 그 짐승을 빌려 온 사람이 그것을 배상할 필요가 없다. 그 짐승이 세를 낸 것이라도 이미 셋돈을 주고 가져왔으므로 배상하지 않아도 된다'
