출애굽기 21:1-22:15

 하나님께서는 백성들에게 종에 관한 법, 사형 죄에 관한 법, 그리고 사람이나 재산에 손해를 입힌 자에 관한 법 등을 율례로 주셨다. 종에 관한 법에는 종의 해방과 여종에 관한 법이 포함되었다. 사형 죄로는 타살, 부모 구타, 유괴, 부모 저주 등이 있었다. 그리고 손해 배상을 해야 할 죄로는 절도와 화재 등의 과실, 위탁물의 손상 및 차용물의 피해 등이 있었다.
  
  개인의 권리에 관한 법(21:1-21:36)    
 
  1. あなたが 彼らの 前に 立てる 定めは 次のとおりである．
  2. あなたが ヘブル 人の 奴隷を 買う 場合， 彼は 六年間， 仕え， 七年目には 自由の 身として 無償で 去ることができる．
  3. もし 彼が 獨身で 來たのなら， 獨身で 去り， もし 彼に 妻があれば， その 妻は 彼とともに 去ることができる．
  4. もし 彼の 主人が 彼に 妻を 與えて， 妻が 彼に 男の 子， または 女の 子を 産んだのなら， この 妻とその 子どもたちは， その 主人のものとなり， 彼は 獨身で 去らなければならない．
  5. しかし， もし， その 奴隷が， 『私は， 私の 主人と， 私の 妻と， 私の 子どもたちを 愛しています． 自由の 身となって 去りたくありません． 』と， はっきり 言うなら，
  1. "Now these are the ordinances which you are to set before them:
  2. "If you buy a Hebrew slave, he shall serve for six years; but on the seventh he shall go out as a free man without payment.
  3. "If he comes alone, he shall go out alone; if he is the husband of a wife, then his wife shall go out with him.
  4. "If his master gives him a wife, and she bears him sons or daughters, the wife and her children shall belong to her master, and he shall go out alone.
  5. "But if the slave plainly says, 'I love my master, my wife and my children; I will not go out as a free man,'
  1. その 主人は， 彼を 神のもとに 連れて 行き， 戶または 戶口の 柱のところに 連れて 行き， 彼の 耳をきりで 刺し 通さなければならない． 彼はいつまでも 主人に 仕えることができる．
  2. 人が 自分の 娘を 女奴隷として 賣るような 場合， 彼女は 男奴隷が 去る 場合のように 去ることはできない．

  1. then his master shall bring him to God, then he shall bring him to the door or the doorpost. And his master shall pierce his ear with an awl; and he shall serve him permanently.
  2. "If a man sells his daughter as a female slave, she is not to go free as the male slaves do.
  3. "If she is displeasing in the eyes of her master who designated her for himself, then he shall let her be redeemed. He does not have authority to sell her to a foreign people because of his unfairness to her.
  4. "If he designates her for his son, he shall deal with her according to the custom of daughters.
  5. "If he takes to himself another woman, he may not reduce her food, her clothing, or her conjugal rights.
  1. もし 彼がこれら 三つのことを 彼女に 行なわないなら， 彼女は 金を 拂わないで 無償で 去ることができる．
  2. 人を 打って 死なせた 者は， 必ず 殺されなければならない．
  3. ただし， 彼に 殺意がなく， 神が 御手によって 事を 起こされた 場合， わたしはあなたに 彼ののがれる 場所を 指定しよう．

  1. "If he will not do these three things for her, then she shall go out for nothing, without payment of money.
  2. "He who strikes a man so that he dies shall surely be put to death.
  3. "But if he did not lie in wait for him, but God let him fall into his hand, then I will appoint you a place to which he may flee.
  4. "If, however, a man acts presumptuously toward his neighbor, so as to kill him craftily, you are to take him even from My altar, that he may die.
  5. "He who strikes his father or his mother shall surely be put to death.
  1. 人をさらった 者は， その 人を 賣っていても， 自分の 手もとに 置いていても， 必ず 殺されなければならない．
  2. 自分の 父または 母をのろう 者は， 必ず 殺されなければならない．
  3. 人が 爭い， ひとりが 石かこぶしで 相手を 打ち， その 相手が 死なないで 床についた 場合，
  4. もし 再び 起き 上がり， 杖によって， 外を 步くようになれば， 打った 者は 罰せられない． ただ 彼が 休んだ 分を 弁償し， 彼が 完全に 直るようにしてやらなければならない．
  5. 自分の 男奴隷， あるいは 女奴隷を 杖で 打ち， その 場で 死なせた 場合， その 者は 必ず 復讐されなければならない．
  1. "He who kidnaps a man, whether he sells him or he is found in his possession, shall surely be put to death.
  2. "He who curses his father or his mother shall surely be put to death.
  3. "If men have a quarrel and one strikes the other with a stone or with his fist, and he does not die but remains in bed,
  4. if he gets up and walks around outside on his staff, then he who struck him shall go unpunished; he shall only pay for his loss of time, and shall take care of him until he is completely healed.
  5. "If a man strikes his male or female slave with a rod and he dies at his hand, he shall be punished.
  1. ただし， もしその 奴隷が 一日か 二日生きのびたなら， その 者は 復讐されない． 奴隷は 彼の 財産だからである．
  2. 人が 爭っていて， みごもった 女に 突き 當たり， 流産させるが， 殺傷事故がない 場合， 彼はその 女の 夫が 負わせるだけの 罰金を 必ず 拂わなければならない． その 支拂いは 裁定による．
  3. しかし， 殺傷事故があれば， いのちにはいのちを 與えなければならない．
  4. 目には 目． 齒には 齒． 手には 手． 足には 足．
  5. やけどにはやけど． 傷には 傷． 打ち 傷には 打ち 傷．
  1. "If, however, he survives a day or two, no vengeance shall be taken; for he is his property.
  2. "If men struggle with each other and strike a woman with child so that she gives birth prematurely, yet there is no injury, he shall surely be fined as the woman's husband may demand of him, and he shall pay as the judges decide.
  3. "But if there is any further injury, then you shall appoint as a penalty life for life,
  4. eye for eye, tooth for tooth, hand for hand, foot for foot,
  5. burn for burn, wound for wound, bruise for bruise.
  1. 自分の 男奴隷の 片目， あるいは 女奴隷の 片目を 打ち， これをそこなった 場合， その 目の 代償として， その 奴隷を 自由の 身にしなければならない．
  2. また， 自分の 男奴隷の 齒一本， あるいは 女奴隷の 齒一本を 打ち 落としたなら， その 齒の 代償として， その 奴隷を 自由の 身にしなければならない．
  3. 牛が 男または 女を 突いて 殺した 場合， その 牛は 必ず 石で 打ち 殺さなければならない． その 肉を 食べてはならない． しかし， その 牛の 持ち 主は 無罪である．
  4. しかし， もし， 牛が 以前から 突くくせがあり， その 持ち 主が 注意されていても， それを 監視せず， その 牛が 男または 女を 殺したのなら， その 牛は 石で 打ち 殺し， その 持ち 主も 殺されなければならない．
  5. もし 彼に ·い 金が 課せられたなら， 自分に 課せられたものは 何でも， 自分のいのちの 償いとして 支拂わなければならない．
  1. "If a man strikes the eye of his male or female slave, and destroys it, he shall let him go free on account of his eye.
  2. "And if he knocks out a tooth of his male or female slave, he shall let him go free on account of his tooth.
  3. "If an ox gores a man or a woman to death, the ox shall surely be stoned and its flesh shall not be eaten; but the owner of the ox shall go unpunished.
  4. "If, however, an ox was previously in the habit of goring and its owner has been warned, yet he does not confine it and it kills a man or a woman, the ox shall be stoned and its owner also shall be put to death.
  5. "If a ransom is demanded of him, then he shall give for the redemption of his life whatever is demanded of him.
  1. 男の 子を 突いても， 女の 子を 突いても， この 規定のとおりに 處理されなければならない．
  2. もしその 牛が， 男奴隷， あるいは 女奴隷を 突いたなら， 牛の 持ち 主はその 奴隷の 主人に 銀貨三十 シェケル を 支拂い， その 牛は 石で 打ち 殺されなければならない．
  3. 井戶のふたをあけていたり， あるいは， 井戶を 掘って， それにふたをしないでいたりして， 牛やろばがそこに 落ち ¿んだ 場合，
  4. その 井戶の 持ち 主は 金を 支拂って， その 持ち 主に 償いをしなければならない． しかし， その 死んだ 家畜は 彼のものとなる．
  5. ある 人の 牛が， もうひとりの 人の 牛を 突いて， その 牛が 死んだ 場合， 兩者は 生きている 牛を 賣って， その 金を 分け， また 死んだ 牛も 分けなければならない．
  1. "Whether it gores a son or a daughter, it shall be done to him according to the same rule.
  2. "If the ox gores a male or female slave, the owner shall give his or her master thirty shekels of silver, and the ox shall be stoned.
  3. "If a man opens a pit, or digs a pit and does not cover it over, and an ox or a donkey falls into it,
  4. the owner of the pit shall make restitution; he shall give money to its owner, and the dead animal shall become his.
  5. "If one man's ox hurts another's so that it dies, then they shall sell the live ox and divide its price equally; and also they shall divide the dead ox.
  1. しかし， その 牛が 以前から 突くくせのあることがわかっていて， その 持ち 主が 監視をしなかったのなら， その 人は 必ず 牛は 牛で 償わなければならない． しかし， その 死んだ 牛は 自分のものとなる．
  1. "Or if it is known that the ox was previously in the habit of goring, yet its owner has not confined it, he shall surely pay ox for ox, and the dead animal shall become his.
 
  손해 배상에 관한 법(22:1-22:15)    
 
  1. 牛とか 羊を 盜み， これを 殺したり， これを 賣ったりした 場合， 牛一頭を 牛五頭で， 羊一頭を 羊四頭で 償わなければならない．
  2. ··もし， 盜人が， 拔け 穴を 掘って 押し 入るところを 見つけられ， 打たれて 死んだなら， 血の 罪は 打った 者にはない．
  3. もし， 日が 上っていれば， 血の 罪は 打った 者にある． ··盜みをした 者は 必ず 償いをしなければならない． もし 彼が 何も 持っていないなら， 盜んだ 物のために， 彼自身が 賣られなければならない．
  4. もし 盜んだ 物が， 牛でも， ろばでも， 羊でも， 生きたままで 彼の 手の 中にあるのが 確かに 見つかったなら， それを 二倍にして 償わなければならない．
  5. 家畜に 畑やぶどう 畑の 物を 食べさせるとき， その 家畜を 放ち， それが 他人の 畑の 物を 食い 荒らした 場合， その 人は 自分の 畑の 最良の 物と， ぶどう 畑の 最良の 物とをもって， 償いをしなければならない．
  1. "If a man steals an ox or a sheep and slaughters it or sells it, he shall pay five oxen for the ox and four sheep for the sheep.
  2. "If the thief is caught while breaking in and is struck so that he dies, there will be no bloodguiltiness on his account.
  3. "But if the sun has risen on him, there will be bloodguiltiness on his account. He shall surely make restitution; if he owns nothing, then he shall be sold for his theft.
  4. "If what he stole is actually found alive in his possession, whether an ox or a donkey or a sheep, he shall pay double.
  5. "If a man lets a field or vineyard be grazed bare and lets his animal loose so that it grazes in another man's field, he shall make restitution from the best of his own field and the best of his own vineyard.
  1. 火災を 起こし， それがいばらに 燃え 移り， そのため 積み 上げた 穀物の 束， あるいは 立穗， あるいは 畑を 燒き 盡くした 場合， 出火させた 者は， 必ず 償いをしなければならない．
  2. 金錢あるいは 物品を， 保管のために 隣人に 預け， それがその 人の 家から 盜まれた 場合， もし， その 盜人が 見つかったなら， 盜人はそれを 二倍にして 償わなければならない．
  3. もし， 盜人が 見つからないなら， その 家の 主人は 神の 前に 出て， 彼が 隣人の 財産に 絶對に 手をかけなかったことを 誓わなければならない．
  4. すべての 橫領事件に 際し， 牛でも， ろばでも， 羊でも， 着物でも， どんな 紛失物でも， 一方が， 『それは 自分のものだ． 』と 言う 場合， その 雙方の 言い 分を， 神の 前に 持ち 出さなければならない． そして， 神が 罪に 定めた 者は， それを 二倍にして 相手に 償わなければならない．
  5. ろばでも， 牛でも， 羊でも， またどんな 家畜でも， その 番をしてもらうために 隣人に 預け， それが 死ぬとか， 傷つくとか， 奪い 去られるとかして， 目擊者がいない 場合，
  1. "If a fire breaks out and spreads to thorn bushes, so that stacked grain or the standing grain or the field itself is consumed, he who started the fire shall surely make restitution.
  2. "If a man gives his neighbor money or goods to keep for him and it is stolen from the man's house, if the thief is caught, he shall pay double.
  3. "If the thief is not caught, then the owner of the house shall appear before the judges, to determine whether he laid his hands on his neighbor's property.
  4. "For every breach of trust, whether it is for ox, for donkey, for sheep, for clothing, or for any lost thing about which one says, 'This is it,' the case of both parties shall come before the judges; he whom the judges condemn shall pay double to his neighbor.
  5. "If a man gives his neighbor a donkey, an ox, a sheep, or any animal to keep for him, and it dies or is hurt or is driven away while no one is looking,
  1. 隣人の 財産に 絶對に 手をかけなかったという 主への 誓いが， 雙方の 間に， なければならない． その 持ち 主がこれを 受け 入れるなら， 隣人は 償いをする 必要はない．
  2. しかし， もしそれが 確かに 自分のところから 盜まれたのなら， その 持ち 主に 償いをしなければならない．
  3. もしそれが 確かに 野¿に 裂き 殺されたのなら， 證據としてそれを 持って 行かなければならない． 裂き 殺されたものの 償いをする 必要はない．
  4. 人が 隣人から 家畜を 借り， それが 傷つくか， 死ぬかして， その 持ち 主がいっしょにいなかった 場合は， 必ず 償いをしなければならない．
  5. もし， 持ち 主がいっしょにいたなら， 償いをする 必要はない． しかし， それが 賃借りの 物であったなら， 借り 賃は 拂わなければならない．
  1. an oath before the LORD shall be made by the two of them that he has not laid hands on his neighbor's property; and its owner shall accept it, and he shall not make restitution.
  2. "But if it is actually stolen from him, he shall make restitution to its owner.
  3. "If it is all torn to pieces, let him bring it as evidence; he shall not make restitution for what has been torn to pieces.
  4. "If a man borrows anything from his neighbor, and it is injured or dies while its owner is not with it, he shall make full restitution.
  5. "If its owner is with it, he shall not make restitution; if it is hired, it came for its hire.
