출애굽기 21:1-22:15

 하나님께서는 백성들에게 종에 관한 법, 사형 죄에 관한 법, 그리고 사람이나 재산에 손해를 입힌 자에 관한 법 등을 율례로 주셨다. 종에 관한 법에는 종의 해방과 여종에 관한 법이 포함되었다. 사형 죄로는 타살, 부모 구타, 유괴, 부모 저주 등이 있었다. 그리고 손해 배상을 해야 할 죄로는 절도와 화재 등의 과실, 위탁물의 손상 및 차용물의 피해 등이 있었다.
  
  개인의 권리에 관한 법(21:1-21:36)    
 
  1. "Now these are the ordinances which you are to set before them:
  2. "If you buy a Hebrew slave, he shall serve for six years; but on the seventh he shall go out as a free man without payment.
  3. "If he comes alone, he shall go out alone; if he is the husband of a wife, then his wife shall go out with him.
  4. "If his master gives him a wife, and she bears him sons or daughters, the wife and her children shall belong to her master, and he shall go out alone.
  5. "But if the slave plainly says, 'I love my master, my wife and my children; I will not go out as a free man,'
  1. "네가 백성 앞에서 공포하여야 할 법규는 다음과 같다.
  2. 너희가 히브리 종을 사면, 그는 여섯 해 동안 종살이를 해야 하고, 일곱 해가 되면, 아무런 몸값을 내지 않고서도 자유의 몸이 된다.
  3. 그가, 혼자 종이 되어 들어왔으면 혼자 나가고, 아내를 데리고 종으로 들어왔으면 아내를 데리고 나간다.
  4. 그러나 그의 주인이 그에게 아내를 주어서, 그 아내가 아들이나 딸을 낳았으면, 그 아내와 아이들은 주인의 것이므로, 그는 혼자 나간다.
  5. 그러나 그 종이 '나는 나의 주인과 나의 처자를 사랑하므로, 혼자 자유를 얻어 나가지 않겠다' 하고 선언하면,
  1. then his master shall bring him to God, then he shall bring him to the door or the doorpost. And his master shall pierce his ear with an awl; and he shall serve him permanently.
  2. "If a man sells his daughter as a female slave, she is not to go free as the male slaves do.
  3. "If she is displeasing in the eyes of her master who designated her for himself, then he shall let her be redeemed. He does not have authority to sell her to a foreign people because of his unfairness to her.
  4. "If he designates her for his son, he shall deal with her according to the custom of daughters.
  5. "If he takes to himself another woman, he may not reduce her food, her clothing, or her conjugal rights.
  1. 주인은 그를 하나님 앞으로 데리고 가서, 그의 귀를 문이나 문설주에 대고 송곳으로 뚫는다. 그러면 그는 영원히 주인의 종이 된다.
  2. 남의 딸을 종으로 샀을 경우에는, 남종을 내보내듯이 그렇게 내보내지는 못한다.
  3. 주인이 아내로 삼으려고 그 여자를 샀으나, 그 여자가 마음에 들지 않으면, 그는 그 여자에게 몸값을 얹어서 그 여자의 아버지에게 되돌려 보내야 한다. 그가 그 여자를 속인 것이므로, 그 여자를 외국 사람에게 팔아서는 안 된다.
  4. 그가 그 여종을 자기의 아들에게 주려고 샀으면, 그는 그 여자를 딸처럼 대접하여야 한다.
  5. 한 남자가 아내를 두고 또 다른 아내를 맞아들였을 때에, 그는 그의 첫 아내에게 먹을 것과 입을 것을 줄여서 주거나 그 아내와 부부 관계를 끊어서는 안 된다.
  1. "If he will not do these three things for her, then she shall go out for nothing, without payment of money.
  2. "He who strikes a man so that he dies shall surely be put to death.
  3. "But if he did not lie in wait for him, but God let him fall into his hand, then I will appoint you a place to which he may flee.
  4. "If, however, a man acts presumptuously toward his neighbor, so as to kill him craftily, you are to take him even from My altar, that he may die.
  5. "He who strikes his father or his mother shall surely be put to death.
  1. 그가 그의 첫 여자에게 이 세 가지 의무를 다 하지 않으려거든, 그 여자를 자유롭게 풀어 주고, 아무런 몸값도 받지 않아야 한다."
  2. "사람을 때려서 죽인 자는 반드시 사형에 처하여야 한다.
  3. 그가 일부러 죽인 것이 아니라 실수로 죽였으면, 내가 너희에게 정하여 주는 곳으로 피신할 수 있다.
  4. 그러나 홧김에 일부러 이웃을 죽인 자는, 나의 제단으로 피하여 오더라도 끌어내서 죽여야 한다.
  5. 자기 부모를 때린 자는 반드시 사형에 처하여야 한다.
  1. "He who kidnaps a man, whether he sells him or he is found in his possession, shall surely be put to death.
  2. "He who curses his father or his mother shall surely be put to death.
  3. "If men have a quarrel and one strikes the other with a stone or with his fist, and he does not die but remains in bed,
  4. if he gets up and walks around outside on his staff, then he who struck him shall go unpunished; he shall only pay for his loss of time, and shall take care of him until he is completely healed.
  5. "If a man strikes his male or female slave with a rod and he dies at his hand, he shall be punished.
  1. 사람을 유괴한 자는, 그 사람을 팔았든지 자기가 데리고 있든지, 반드시 사형에 처하여야 한다.
  2. 자기 부모를 저주하는 자는 반드시 사형에 처하여야 한다.
  3. 사람이 서로 싸우다가, 어느 한 사람이 상대방을 돌이나 주먹으로 때려서, 그가 죽지는 않았으나 자리에 눕게 되었는데,
  4. 그가 일어나서 지팡이를 짚고서라도 길을 다닐 수 있게 되면, 때린 사람은 형벌을 받지는 않으나, 그 동안에 입은 손해를 갚아 주고, 다 나을 때까지 치료비를 대주어야 한다.
  5. 어떤 사람이 자기의 남종이나 여종을 몽둥이로 때렸는데, 그 종이 그 자리에서 죽으면, 그는 반드시 형벌을 받아야 한다.
  1. "If, however, he survives a day or two, no vengeance shall be taken; for he is his property.
  2. "If men struggle with each other and strike a woman with child so that she gives birth prematurely, yet there is no injury, he shall surely be fined as the woman's husband may demand of him, and he shall pay as the judges decide.
  3. "But if there is any further injury, then you shall appoint as a penalty life for life,
  4. eye for eye, tooth for tooth, hand for hand, foot for foot,
  5. burn for burn, wound for wound, bruise for bruise.
  1. 그러나 그들이 하루나 이틀을 더 살면, 주인은 형벌을 받지 않는다. 종은 주인의 재산이기 때문이다.
  2. 사람이 서로 싸우다가, 임신한 여자를 다치게 하였는데, 낙태만 하고 달리 더 다친 데가 없으면, 가해자는 그 여자의 남편이 요구하는 대로 반드시 배상금을 내되, 배상금액은 재판관의 판결을 따른다.
  3. 그러나 그 여자가 다쳤으면, 가해자에게는, 목숨은 목숨으로,
  4. 눈은 눈으로, 이는 이로, 손은 손으로, 발은 발로,
  5. 화상은 화상으로, 상처는 상처로, 멍은 멍으로 갚아야 한다.
  1. "If a man strikes the eye of his male or female slave, and destroys it, he shall let him go free on account of his eye.
  2. "And if he knocks out a tooth of his male or female slave, he shall let him go free on account of his tooth.
  3. "If an ox gores a man or a woman to death, the ox shall surely be stoned and its flesh shall not be eaten; but the owner of the ox shall go unpunished.
  4. "If, however, an ox was previously in the habit of goring and its owner has been warned, yet he does not confine it and it kills a man or a woman, the ox shall be stoned and its owner also shall be put to death.
  5. "If a ransom is demanded of him, then he shall give for the redemption of his life whatever is demanded of him.
  1. 어떤 사람이 자기 남종의 눈이나 여종의 눈을 때려서 멀게 하면, 그 눈을 멀게 한 값으로, 그 종에게 자유를 주어서 내보내야 한다.
  2. 그가 자기 남종의 이나 여종의 이를 부러뜨리면, 그 이를 부러뜨린 값으로, 그 종에게 자유를 주어서 내보내야 한다."
  3. "소가 어떤 남자나 여자를 받아서 죽이면, 그 소는 반드시 돌로 쳐서 죽여야 한다. 처형된 소는 먹어서는 안 된다. 이 경우에 소의 임자는 형벌을 받지 않는다.
  4. 그러나 그 소에게 받는 버릇이 있는데, 그 임자가 남에게 경고를 받고도 단속하지 않아서 어떤 남자나 여자를 죽게 하였으면, 그 소만 돌로 쳐서 죽일 것이 아니라, 그 임자도 함께 죽여야 한다.
  5. 그러나 피해자 가족이 원하면, 소 임자를 처형하는 대신에, 그에게 배상금을 물릴 수 있다. 그 때에 그 배상금 액수는 재판관이 정한다.
  1. "Whether it gores a son or a daughter, it shall be done to him according to the same rule.
  2. "If the ox gores a male or female slave, the owner shall give his or her master thirty shekels of silver, and the ox shall be stoned.
  3. "If a man opens a pit, or digs a pit and does not cover it over, and an ox or a donkey falls into it,
  4. the owner of the pit shall make restitution; he shall give money to its owner, and the dead animal shall become his.
  5. "If one man's ox hurts another's so that it dies, then they shall sell the live ox and divide its price equally; and also they shall divide the dead ox.
  1. 또 소가 나이 어린 소년이나 소녀를 받아 죽게 하였을 경우에도, 그 소 임자에게 같은 법을 적용한다.
  2. 소가 남종이나 여종을 받아 죽게 하였으면, 소 임자는 그 종의 주인에게 은 삼십 세겔을 주고, 그 소는 돌로 쳐서 죽여야 한다.
  3. 어떤 사람이 구덩이를 열어 놓거나, 구덩이를 파고 그것을 덮지 않아서, 소나 나귀가 거기에 빠졌을 경우에는,
  4. 그 구덩이의 임자는 짐승의 임자에게 그것을 돈으로 배상하여야 한다. 그러나 죽은 짐승은 구덩이 임자의 것이 된다.
  5. 어떤 사람의 소가 그 이웃의 소를 받아서 죽게 하였을 경우에는, 살아 있는 소는 팔아서 그 돈을 나누어 가지고, 죽은 소는 고기를 나누어 가진다.
  1. "Or if it is known that the ox was previously in the habit of goring, yet its owner has not confined it, he shall surely pay ox for ox, and the dead animal shall become his.
  1. 그 소에게 받는 버릇이 있다는 것을 알면서도 그 임자가 단속하지 않았으면, 그는 반드시 살아 있는 소로 배상하고, 자기는 죽은 소를 가져야 한다."
 
  손해 배상에 관한 법(22:1-22:15)    
 
  1. "If a man steals an ox or a sheep and slaughters it or sells it, he shall pay five oxen for the ox and four sheep for the sheep.
  2. "If the thief is caught while breaking in and is struck so that he dies, there will be no bloodguiltiness on his account.
  3. "But if the sun has risen on him, there will be bloodguiltiness on his account. He shall surely make restitution; if he owns nothing, then he shall be sold for his theft.
  4. "If what he stole is actually found alive in his possession, whether an ox or a donkey or a sheep, he shall pay double.
  5. "If a man lets a field or vineyard be grazed bare and lets his animal loose so that it grazes in another man's field, he shall make restitution from the best of his own field and the best of his own vineyard.
  1. "어떤 사람이 소나 양을 도둑질하여 그것을 잡거나 팔면, 그는 소 한 마리에는 소 다섯 마리로, 양 한 마리에는 양 네 마리로 갚아야 한다.
  2. 밤에 도둑이 몰래 들어온 것을 알고서, 그를 때려서 죽였을 경우에는, 죽인 사람에게 살인죄가 없다.
  3. 그러나 해가 뜬 다음에 이런 일이 생기면, 그에게 살인죄가 있다. （훔친 것은 반드시 물어 내야 한다. 그가 가진 것이 아무것도 없으면, 자기 몸을 종으로 팔아서라도, 훔친 것은 물어 내야 한다.
  4. 그가 도둑질한 짐승이 소든지 나귀든지 양이든지, 아직 산 채로 그의 손에 있으면, 그는 그것을 두 갑절로 물어주어야 한다.）
  5. 어떤 사람이 밭이나 포도원에서 집짐승을 풀어 놓아서 풀을 뜯게 하다가, 이 집짐승이 남의 밭의 농작물을 모두 뜯어먹었으면, 그는 자기 밭의 가장 좋은 소출과 자기 포도원의 가장 좋은 소출로 그것을 물어주어야 한다.
  1. "If a fire breaks out and spreads to thorn bushes, so that stacked grain or the standing grain or the field itself is consumed, he who started the fire shall surely make restitution.
  2. "If a man gives his neighbor money or goods to keep for him and it is stolen from the man's house, if the thief is caught, he shall pay double.
  3. "If the thief is not caught, then the owner of the house shall appear before the judges, to determine whether he laid his hands on his neighbor's property.
  4. "For every breach of trust, whether it is for ox, for donkey, for sheep, for clothing, or for any lost thing about which one says, 'This is it,' the case of both parties shall come before the judges; he whom the judges condemn shall pay double to his neighbor.
  5. "If a man gives his neighbor a donkey, an ox, a sheep, or any animal to keep for him, and it dies or is hurt or is driven away while no one is looking,
  1. 불이 나서 가시덤불로 옮겨붙어서, 남의 낟가리나 거두지 않은 곡식이나 밭을 태웠으면, 불을 놓은 사람은 그것을 반드시 물어주어야 한다.
  2. 어떤 사람이 그 이웃에게 돈이나 물품을 보관하여 달라고 맡겼는데, 그 맡은 집에 도둑이 들었을 때에, 그 도둑이 잡히면, 도둑이 그것을 갑절로 물어 내야 한다.
  3. 그러나 도둑이 잡히지 않으면, 그 집 주인이 하나님 앞으로 나가서, 그 이웃의 물건에 손을 댔는지 안 댔는지를 판결받아야 한다.
  4. 소든지 나귀든지 양이든지 의복이든지, 그 밖의 어떤 분실물이든지, 그것을 서로 자기 것이라고 주장하는 사건이 생기면, 양쪽 다 하나님 앞으로 나아가야 하며, 하나님께 유죄 판결을 받은 사람은 그 상대방에게 갑절로 물어주어야 한다.
  5. 어떤 사람이 그 이웃에게, 나귀든지 소든지 양이든지, 그 밖의 어떤 집짐승이든지, 무엇이든지 지켜 달라고 맡겼는데, 그것이 죽거나 다치거나 아무도 모르게 없어졌으면,
  1. an oath before the LORD shall be made by the two of them that he has not laid hands on his neighbor's property; and its owner shall accept it, and he shall not make restitution.
  2. "But if it is actually stolen from him, he shall make restitution to its owner.
  3. "If it is all torn to pieces, let him bring it as evidence; he shall not make restitution for what has been torn to pieces.
  4. "If a man borrows anything from his neighbor, and it is injured or dies while its owner is not with it, he shall make full restitution.
  5. "If its owner is with it, he shall not make restitution; if it is hired, it came for its hire.
  1. 그것을 맡은 사람이 이웃의 짐승을 가로채지 않았음을 주 앞에서 맹세함으로써, 둘의 옳고 그름을 가려야 한다. 이 경우에 그 임자가 맹세를 받아들이면, 그는 물어 내지 않아도 된다.
  2. 그러나 도둑맞은 것이 확실하면, 그는 그 임자에게 도둑맞은 것을 물어주어야 한다.
  3. 그것이 맹수에게 찢겨서 죽었으면, 그 증거물을 가져다 주어야 하는데, 이 경우에 그는 그 찢겨서 죽은 것을 물어주지 않아도 된다.
  4. 어떤 사람이 그 이웃에게서 짐승을 빌려 왔는데, 그것이 다치거나 죽을 때에, 그 임자가 그 자리에 함께 있지 않았으면, 그는 반드시 물어주어야 한다.
  5. 그러나 그 임자가 그 자리에 함께 있었으면, 그는 그 짐승을 물어주지 않아도 된다. 그 짐승이 세를 낸 것이면, 그 셋돈을 계산해서 주어야 한다."
