출애굽기 21:1-22:15

 하나님께서는 백성들에게 종에 관한 법, 사형 죄에 관한 법, 그리고 사람이나 재산에 손해를 입힌 자에 관한 법 등을 율례로 주셨다. 종에 관한 법에는 종의 해방과 여종에 관한 법이 포함되었다. 사형 죄로는 타살, 부모 구타, 유괴, 부모 저주 등이 있었다. 그리고 손해 배상을 해야 할 죄로는 절도와 화재 등의 과실, 위탁물의 손상 및 차용물의 피해 등이 있었다.
  
  개인의 권리에 관한 법(21:1-21:36)    
 
  1. "Now these are the ordinances which you are to set before them:
  2. "If you buy a Hebrew slave, he shall serve for six years; but on the seventh he shall go out as a free man without payment.
  3. "If he comes alone, he shall go out alone; if he is the husband of a wife, then his wife shall go out with him.
  4. "If his master gives him a wife, and she bears him sons or daughters, the wife and her children shall belong to her master, and he shall go out alone.
  5. "But if the slave plainly says, 'I love my master, my wife and my children; I will not go out as a free man,'
  1. 以下は， あなたが 彼らに 示すべき 法である．
  2. あなたが ヘブライ 人である 奴隷を 買うならば， 彼は 六年間奴隷として ¿かねばならないが， 七年目には 無償で 自由の 身となることができる．
  3. もし， 彼が 獨身で 來た 場合は， 獨身で 去らねばならない． もし， 彼が 妻帶者であった 場合は， その 妻も 共に 去ることができる．
  4. もし， 主人が 彼に 妻を 與えて， その 妻が 彼との 間に 息子あるいは 娘を 産んだ 場合は， その 妻と 子供は 主人に 屬し， 彼は 獨身で 去らねばならない．
  5. もし， その 奴隷が， 「わたしは 主人と 妻子とを 愛しており， 自由の 身になる 意志はありません 」と 明言する 場合は，
  1. then his master shall bring him to God, then he shall bring him to the door or the doorpost. And his master shall pierce his ear with an awl; and he shall serve him permanently.
  2. "If a man sells his daughter as a female slave, she is not to go free as the male slaves do.
  3. "If she is displeasing in the eyes of her master who designated her for himself, then he shall let her be redeemed. He does not have authority to sell her to a foreign people because of his unfairness to her.
  4. "If he designates her for his son, he shall deal with her according to the custom of daughters.
  5. "If he takes to himself another woman, he may not reduce her food, her clothing, or her conjugal rights.
  1. 主人は 彼を 神のもとに 連れて 行く． 入り 口もしくは 入り 口の 柱のところに 連れて 行き， 彼の 耳を 錐で 刺し 通すならば， 彼を 生涯， 奴隷とすることができる．
  2. 人が 自分の 娘を 女奴隷として 賣るならば， 彼女は， 男奴隷が 去るときと 同じように 去ることはできない．
  3. もし， 主人が 彼女を 一度自分のものと 定めながら， 氣に 入らなくなった 場合は， 彼女が 買い 戾されることを 許さねばならない． 彼は 彼女を 裏切ったのだから， 外國人に 賣る 權利はない．
  4. もし， 彼女を 自分の 息子のものと 定めた 場合は， 自分の 娘と 同じように 扱わなければならない．
  5. もし， 彼が 別の 女をめとった 場合も， 彼女から 食事， 衣服， 夫婦の 交わりを 減らしてはならない．
  1. "If he will not do these three things for her, then she shall go out for nothing, without payment of money.
  2. "He who strikes a man so that he dies shall surely be put to death.
  3. "But if he did not lie in wait for him, but God let him fall into his hand, then I will appoint you a place to which he may flee.
  4. "If, however, a man acts presumptuously toward his neighbor, so as to kill him craftily, you are to take him even from My altar, that he may die.
  5. "He who strikes his father or his mother shall surely be put to death.
  1. もし， 彼がこの 三つの 事柄を 實行しない 場合は， 彼女は 金を 支拂わずに 無償で 去ることができる．
  2. 人を 打って 死なせた 者は 必ず 死刑に 處せられる．
  3. ただし， 故意にではなく， 偶然， 彼の 手に 神が 渡された 場合は， わたしはあなたのために 一つの 場所を 定める． 彼はそこに 逃れることができる．
  4. しかし， 人が 故意に 隣人を 殺そうとして 暴力を 振るうならば， あなたは 彼をわたしの 祭壇のもとからでも 連れ 出して， 處刑することができる．
  5. 自分の 父あるいは 母を 打つ 者は， 必ず 死刑に 處せられる．
  1. "He who kidnaps a man, whether he sells him or he is found in his possession, shall surely be put to death.
  2. "He who curses his father or his mother shall surely be put to death.
  3. "If men have a quarrel and one strikes the other with a stone or with his fist, and he does not die but remains in bed,
  4. if he gets up and walks around outside on his staff, then he who struck him shall go unpunished; he shall only pay for his loss of time, and shall take care of him until he is completely healed.
  5. "If a man strikes his male or female slave with a rod and he dies at his hand, he shall be punished.
  1. 人を 誘拐する 者は， 彼を 賣った 場合も， 自分の 手もとに 置いていた 場合も， 必ず 死刑に 處せられる．
  2. 自分の 父あるいは 母を 呪う 者は， 必ず 死刑に 處せられる．
  3. 人¿が 爭って， 一人が 他の 一人を 石， もしくはこぶしで 打った 場合は， 彼が 死なないで， 床に 伏しても，
  4. もし， 回復して， 杖を 賴りに 外を 步き 回ることができるようになるならば， 彼を 打った 者は 罰を 免れる． ただし， 仕事を 休んだ 分を 補償し， 完全に 治療させねばならない．
  5. 人が 自分の 男奴隷あるいは 女奴隷を 棒で 打ち， その 場で 死なせた 場合は， 必ず 罰せられる．
  1. "If, however, he survives a day or two, no vengeance shall be taken; for he is his property.
  2. "If men struggle with each other and strike a woman with child so that she gives birth prematurely, yet there is no injury, he shall surely be fined as the woman's husband may demand of him, and he shall pay as the judges decide.
  3. "But if there is any further injury, then you shall appoint as a penalty life for life,
  4. eye for eye, tooth for tooth, hand for hand, foot for foot,
  5. burn for burn, wound for wound, bruise for bruise.
  1. ただし， 一兩日でも 生きていた 場合は， 罰せられない． それは 自分の 財産だからである．
  2. 人¿がけんかをして， 妊娠している 女を 打ち， 流産させた 場合は， もしその 他の 損傷がなくても， その 女の 主人が 要求する 賠償を 支拂わねばならない． 仲裁者の 裁定に 從ってそれを 支拂わねばならない．
  3. もし， その 他の 損傷があるならば， 命には 命，
  4. 目には 目， 齒には 齒， 手には 手， 足には 足，
  5. やけどにはやけど， 生傷には 生傷， 打ち 傷には 打ち 傷をもって 償わねばならない．
  1. "If a man strikes the eye of his male or female slave, and destroys it, he shall let him go free on account of his eye.
  2. "And if he knocks out a tooth of his male or female slave, he shall let him go free on account of his tooth.
  3. "If an ox gores a man or a woman to death, the ox shall surely be stoned and its flesh shall not be eaten; but the owner of the ox shall go unpunished.
  4. "If, however, an ox was previously in the habit of goring and its owner has been warned, yet he does not confine it and it kills a man or a woman, the ox shall be stoned and its owner also shall be put to death.
  5. "If a ransom is demanded of him, then he shall give for the redemption of his life whatever is demanded of him.
  1. 人が 自分の 男奴隷あるいは 女奴隷の 目を 打って， 目がつぶれた 場合， その 目の 償いとして， その 者を 自由にして 去らせねばならない．
  2. もし， 自分の 男奴隷あるいは 女奴隷の 齒を 折った 場合， その 齒の 償いとして， その 者を 自由に 去らせねばならない．
  3. 牛が 男あるいは 女を 突いて 死なせた 場合， その 牛は 必ず 石で 打ち 殺されねばならない． また， その 肉は 食べてはならない． しかし， その 牛の 所有者に 罪はない．
  4. ただし， もし， その 牛に 以前から 突く 癖があり， 所有者に 警告がなされていたのに， 彼がその 警告を 守らず， 男あるいは 女を 死なせた 場合は， 牛は 石で 打ち 殺され， 所有者もまた 死刑に 處せられる．
  5. もし， 賠償金が 要求された 場合には， 自分の 命の 代償として， 要求されたとおりに 支拂わねばならない．
  1. "Whether it gores a son or a daughter, it shall be done to him according to the same rule.
  2. "If the ox gores a male or female slave, the owner shall give his or her master thirty shekels of silver, and the ox shall be stoned.
  3. "If a man opens a pit, or digs a pit and does not cover it over, and an ox or a donkey falls into it,
  4. the owner of the pit shall make restitution; he shall give money to its owner, and the dead animal shall become his.
  5. "If one man's ox hurts another's so that it dies, then they shall sell the live ox and divide its price equally; and also they shall divide the dead ox.
  1. 男の 子あるいは 女の 子を 突いた 場合も， この 規定に 準じて 處理されねばならない．
  2. もし， 牛が 男奴隷あるいは 女奴隷を 突いた 場合は， 銀三十 シェケル をその 主人に 支拂い， その 牛は 石で 打ち 殺されねばならない．
  3. 人が 水溜めをあけたままにしておくか， 水溜めを 掘って， それに 蓋をしないでおいたため， そこに 牛あるいはろばが 落ちた 場合，
  4. その 水溜めの 所有者はそれを 償い， 牛あるいはろばの 所有者に 銀を 支拂う． ただし， 死んだ 家畜は 彼のものとなる．
  5. ある 人の 牛が 隣人の 牛を 突いて 死なせた 場合， 生きている 方の 牛を 賣って， その 代金を 折半し， 死んだ 方の 牛も 折半する．
  1. "Or if it is known that the ox was previously in the habit of goring, yet its owner has not confined it, he shall surely pay ox for ox, and the dead animal shall become his.
  1. しかし， 牛に 以前から 突く 癖のあることが 分かっていながら， 所有者が 注意を 怠った 場合は， 必ず， その 牛の 代償として 牛で 償わねばならない． ただし， 死んだ 牛は 彼のものとなる．
 
  손해 배상에 관한 법(22:1-22:15)    
 
  1. "If a man steals an ox or a sheep and slaughters it or sells it, he shall pay five oxen for the ox and four sheep for the sheep.
  2. "If the thief is caught while breaking in and is struck so that he dies, there will be no bloodguiltiness on his account.
  3. "But if the sun has risen on him, there will be bloodguiltiness on his account. He shall surely make restitution; if he owns nothing, then he shall be sold for his theft.
  4. "If what he stole is actually found alive in his possession, whether an ox or a donkey or a sheep, he shall pay double.
  5. "If a man lets a field or vineyard be grazed bare and lets his animal loose so that it grazes in another man's field, he shall make restitution from the best of his own field and the best of his own vineyard.
  1. もし， 盜人が 壁に 穴をあけて 入るところを 見つけられ， 打たれて 死んだ 場合， 殺した 人に 血を 流した 罪はない．
  2. a しかし， 太陽が 昇っているならば， 殺した 人に 血を 流した 責任がある．b 彼は 必ず 償わなければならない． もし， 彼が 何も 持っていない 場合は， その 盜みの 代償として 身賣りせねばならない．
  3. もし， 牛であれ， ろばであれ， 羊であれ， 盜まれたものが 生きたままで 彼の 手もとに 見つかった 場合は， 二倍にして 償わねばならない．
  4. 人が 畑あるいはぶどう 畑で 家畜に 草を 食べさせるとき， 自分の 家畜を 放って， 他人の 畑で 草を 食べさせたならば， 自分の 畑とぶどう 畑の 最上の 産物をもって 償わねばならない．
  5. 火が 出て， 茨に 燃え 移り， 麥束， 立ち 穗， あるいは 畑のものを 燒いた 場合， 火を 出した 者が 必ず 償わねばならない．
  1. "If a fire breaks out and spreads to thorn bushes, so that stacked grain or the standing grain or the field itself is consumed, he who started the fire shall surely make restitution.
  2. "If a man gives his neighbor money or goods to keep for him and it is stolen from the man's house, if the thief is caught, he shall pay double.
  3. "If the thief is not caught, then the owner of the house shall appear before the judges, to determine whether he laid his hands on his neighbor's property.
  4. "For every breach of trust, whether it is for ox, for donkey, for sheep, for clothing, or for any lost thing about which one says, 'This is it,' the case of both parties shall come before the judges; he whom the judges condemn shall pay double to his neighbor.
  5. "If a man gives his neighbor a donkey, an ox, a sheep, or any animal to keep for him, and it dies or is hurt or is driven away while no one is looking,
  1. 人が 銀あるいは 物品の 保管を 隣人に 託し， それが 隣人の 家から 盜まれた 場合， もし， その 盜人が 見つかれば， 盜人は 二倍にして 償わねばならない．
  2. もし， 盜人が 見つからない 場合は， その 家の 主人が 神の 御もとに 進み 出て， 自分は 決して 隣人の 持ち 物に 手をかけなかったことを 誓わねばならない．
  3. 牛， ろば， 羊， あるいは 衣服， その 他すべての 紛失物について 言い 爭いが 生じ， 一方が， 「それは 自分の 物です 」と 言うとき， 兩者の 言い 分は 神の 御もとに 出され， 神が 有罪とした 者が， 隣人に 二倍の 償いをせねばならない．
  4. 人が 隣人にろば， 牛， 羊， その 他の 家畜を 預けたならば， それが 死ぬか， 傷つくか， 奪われるかして， しかもそれを 見た 者がいない 場合，
  5. 自分は 決して 隣人の 持ち 物に 手をかけなかった， と 兩者の 間で 主に 誓いがなされねばならない． そして， 所有者はこれを 受け 入れ， 預かった 人は 償う 必要はない．
  1. an oath before the LORD shall be made by the two of them that he has not laid hands on his neighbor's property; and its owner shall accept it, and he shall not make restitution.
  2. "But if it is actually stolen from him, he shall make restitution to its owner.
  3. "If it is all torn to pieces, let him bring it as evidence; he shall not make restitution for what has been torn to pieces.
  4. "If a man borrows anything from his neighbor, and it is injured or dies while its owner is not with it, he shall make full restitution.
  5. "If its owner is with it, he shall not make restitution; if it is hired, it came for its hire.
  1. ただし， 彼のところから 確かに 盜まれた 場合は， 所有者に 償わねばならない．
  2. もし， 野¿にかみ 殺された 場合は， 證據を 持って 行く． かみ 殺されたものに 對しては， 償う 必要はない．
  3. 人が 隣人から 家畜を 借りて， それが 傷つくか， 死んだならば， 所有者が 一緖にいなかったときには 必ず 償わねばならない．
  4. もし， 所有者が 一緖にいたならば， 償う 必要はない． ただし， それが 賃借りしたものであれば， 借り 賃は 支拂わねばならない．
  5. 人がまだ 婚約していない 處女を 誘惑し， 彼女と 寢たならば， 必ず 結納金を 拂って， 自分の 妻としなければならない．
